Who must comply with the CCPA?

The CCPA applies to for-profit companies, doing business in California, that collect California consumers' personal information or companies which have the information collected on their behalf.  If any of the following criteria is met, CCPA applies to you.

  • Annual gross revenues in excess of 25 million
  • Annually buys, receives for its commercial purposes, sells, or shares for commercial purposes personal information relating to 50,000 or more consumers, households, or devices, or
  • Derives 50% or more of its annual revenues from selling consumers’ personal information.

An entity must also comply if it controls or is controlled by a business that meets the above requirements and shares common branding with the entity, such as a shared name, service mark, or trademark.

Even if your business is not based in California, if you do business with Californians and meet any of these criteria, CCPA applies to you.  CCPA becomes effective January 1, 2020.
